This website is operated by Tranquil Haus Ltd T/A Milk and Moon. Throughout the site, the terms “we”, “us” and “our” refer to Milk and Moon. Milk and Moon offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.
Please read these Terms of Service carefully before accessing or using our website. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new Service, features or tools which are added to the current store shall also be part of the Terms of Service subject to existing contractual arrangements. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

(a) By agreeing to these Terms of Service, you represent that you are at least the age of majority and you have given us your consent to allow any of your minor dependents to use this site.

(a) Certain products or services may be available exclusively online through the website. These products or services may have limited quantities.
(b) We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
(c) Subject to legal requirements:
(i) We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.
(ii) We reserve the right to limit the quantities of any products or services that we offer.
(iii) We reserve the right to discontinue any product at any time.
(iv) We reserve the right to refuse any order you place with us.
(v) We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to an order, we will attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.
(vi) We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, re-sellers or distributors.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
(a) You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. (a) Occasionally there may be information on our site or in the Service that contains typographical errors that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any such errors.
(b) If any information in any related website is inaccurate at any time without prior notice we undertake no obligation to update, amend or clarify information on any related website. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
(a) The guarantees and provisions of the Consumer Guarantees Act 1993 apply to goods sold and services provided by us to you.
(b) We will use our best endeavours to deliver the goods and provide the services contracted for on the day required or on the day we indicate but cannot guarantee delivery on that day as we are dependent upon carriers and third parties for this purpose, non working days, and circumstances beyond our control. We will, however, make deliveries of the goods and services contracted for as is reasonable in the circumstances.
(c) Subject to existing contractual obligations, you agree that from time to time we may change or remove the goods and services advertised or promoted on our website for sale or elsewhere without notice to you.
SECTION 14 - INDEMNIFICATION
(a) You agree to indemnify, defend and hold harmless Milk and Moon and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
(a) In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

(a) The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
(b) If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly we may deny you access to our Services (or any part thereof).SECTION 17 - ENTIRE AGREEMENT
(a) The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

SECTION 21 - GIFT CARDS
(a) All gift cards are valid for 24 months from the date purchased.
(b) A Milk and Moon Gift Card is just like cash - if it’s stolen or lost we won’t be able to give you another one.
(c) Once activated, you can only use it to buy online from www.milkandmoon.co.nz
(d) Gift Cards will not be swapped for cash.
(e) No change will be given.
(f) If a gift card expires, any credit left on it cannot be redeemed, transferred or refunded.
SECTION 22 – COMPETITION & GIVEAWAY TERMS
By entering a Competition or Giveaway, entrants are deemed to have read, understood and accepted the following general Terms and Conditions for Prize Draws and Giveaways:
Promoter
The promoter of this giveaway is Milk and Moon.
Eligibility
a) Entry is open to New Zealand residents aged 18 years or over.
b) Employees of Milk and Moon, their immediate families, and anyone professionally associated with this promotion are not eligible to enter.
c) Every entrant warrants that all information submitted is true, current and complete. Milk and Moon reserves the right to disqualify any entrant who does not comply with these terms and conditions.
Giveaway Period
a) The giveaway opens on 5 November 2025 and closes at 7.30 PM on 20 November 2025 advertised on Instagram & Facebook
b) Entries received after this time will not be eligible.
How to Enter

d) Only open to New Zealand residents
Prize
a) One (1) winner will receive a Milk and Moon Gift Box with a Self Care Journal, Bakuchiol & a 7 n 1 Hair Tool valued at $400.
b) The prize is not transferable, exchangeable, or redeemable for cash or credit.
c) Milk and Moon reserve the right to substitute the prize for one of equal or greater value if necessary.
Winner Selection and Notification
a) The winner will be selected at random from all valid entries received by the closing date.
b) The draw will take place before or on Friday 28 November 2025, and the winner will be notified by email within 3 business days.
c) If the winner does not respond within 5 days of being contacted, a new winner may be selected.
d) All reasonable attempts will be made to contact Competition and Giveaway winners using details provided.
e) The prize draw result and decision by Milk and Moon is final and no correspondence will be entered into.
Prize Delivery
a) The Prize will be left available to be claimed for 12 months, after which the prize (or any remaining balance) will no longer be available. The prize will be delivered to the winner via courier to a New Zealand residential address.
b) Milk and Moon are not responsible for any damage, loss, or delays once the prize is dispatched.
Privacy
a) By entering the giveaway, entrants consent to Milk and Moon collecting and storing their personal information for the purpose of administering the giveaway.
b) Participants also opt-in to receive future marketing emails from Milk and Moon.
c) All information provided by the entrants will be collected, used, stored, disclosed and corrected in accordance with the Privacy Act 2020. All entrants have the right to access their information and request for any personal information to be corrected.
d) This competition features contributions from third-party partner brands.
e) By participating, entrants consent to Milk and Moon sharing relevant details with these partners for prize fulfilment and promotional purposes.
f) The winner’s name and prize details may be published publicly on Milk and Moon’s social media platforms (Instagram, Facebook, TikTok and Pintrest) and included in a marketing email distributed to the Milk and Moon customer database.
g) All entrants consent to participate and co-operate as required in all promotional activities relating to the Competition or Giveaway. If stated, entrants also agree to receiving promotional emails from Milk and Moon or its associated companies (which can be unsubscribed).
h) You may unsubscribe from promotional emails at any time.
i) Instagram is not a sponsor or administrator of the giveaway.
General
a) By entering, entrants agree to these Terms and Conditions.
b) Milk and Moon reserve the right to cancel, suspend, or amend the giveaway if required due to circumstances beyond its control.
c) Milk and Moon reserves the right to amend or change these Terms and Conditions at any time at its sole discretion, including extending, postponing or cancelling the Competition or Giveaway.
d) The promoter’s decisions are final, and no correspondence will be entered into.
